By accessing or using Bot The Builder's website, chatbot builder platform, and related services (collectively, the "Services"), you agree to be legally bound by these Terms and Conditions. These terms constitute a binding agreement between you and 41Labs LLC ("we," "us," or "our").

If you do not agree to these terms, please do not use our Services. Your continued use of Bot The Builder constitutes acceptance of these terms and any future modifications.

2. Legal Capacity

You must be at least 18 years old and possess the legal authority to enter into binding agreements to use our Services. By using Bot The Builder, you represent and warrant that:

  • You are of legal age to form a binding contract
  • You have the authority to bind your organization (if using on behalf of a business)
  • All information you provide is accurate and complete
  • You will comply with all applicable laws and regulations

3. Service License

41Labs LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Bot The Builder in accordance with these terms. This license includes the right to:

  • Access and use the chatbot builder platform
  • Create, train, and deploy AI chatbots
  • Embed chatbots on your websites and applications
  • Access analytics and conversation data for your chatbots

This license is subject to your continued compliance with all terms and conditions. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time.

4. Prohibited Activities

You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Services for illegal, harmful, or fraudulent purposes
  • Infringe upon intellectual property rights of others
  • Attempt to gain unauthorized access to our systems or user accounts
  • Reverse engineer, decompile, or disassemble any part of the platform
  • Scrape, spider, or harvest data from the Services without permission
  • Interfere with other users' access to or use of the Services
  • Upload malicious code, viruses, or harmful content
  • Use the Services to send spam or unsolicited communications
  • Impersonate others or misrepresent your affiliation
  • Create chatbots that violate our acceptable use policy

5. Intellectual Property Rights

All content and materials available through Bot The Builder are protected by intellectual property laws, including:

  • Our IP: The Bot The Builder platform, code, design, logos, and documentation are owned by 41Labs LLC and protected by copyright, trademark, and other proprietary rights.
  • Your Content: You retain all rights to the content you upload or create (training data, chatbot configurations, etc.). You grant us a license to use this content solely to provide the Services.
  • Third-Party IP: You are responsible for ensuring you have the right to use any content you upload to train your chatbots.

You may not use our trademarks, logos, or branding without prior written permission.

6. User Content and Data

You are solely responsible for:

  • All content you upload, including training data and knowledge bases
  • Ensuring you have the right to use and share this content
  • The accuracy and legality of information provided by your chatbots
  • Compliance with data protection laws (GDPR, CCPA, etc.) when deploying chatbots
  • Obtaining necessary consents from end users of your chatbots

We do not endorse, verify, or guarantee the accuracy of user-generated content or chatbot responses.

7. Warranty Disclaimer

Bot The Builder and all Services are provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Non-infringement of third-party rights
  • Accuracy, reliability, or completeness of content
  • Uninterrupted, secure, or error-free operation
  • Specific results or outcomes from using the Services

We do not warrant that the Services will meet your requirements or that chatbot responses will be accurate, appropriate, or compliant with your industry regulations.

8. Limitation of Liability

To the maximum extent permitted by law, 41Labs LLC shall not be liable for:

  • Direct, indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Business interruption or service disruptions
  • Damages arising from chatbot responses or user interactions
  • Third-party claims related to your use of the Services
  • Any damages exceeding the amount you paid us in the past 12 months

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless 41Labs LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of Bot The Builder and the Services
  • Violations of these Terms and Conditions
  • Infringement of third-party intellectual property or privacy rights
  • Content you upload or chatbots you deploy
  • Your end users' interactions with your chatbots
  • Any breach of applicable laws or regulations

10. Account Termination

We reserve the right to suspend or terminate your access to Bot The Builder at any time, with or without notice, for:

  • Violation of these Terms and Conditions
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees (for paid plans)
  • Extended periods of inactivity
  • Any reason at our sole discretion

You may terminate your account at any time by contacting us. Upon termination, your right to use the Services ceases immediately, and we may delete your data after a reasonable grace period.

11. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of Bot The Builder shall be resolved through:

  • Good faith negotiations between the parties
  • Binding arbitration in Wyoming (if negotiation fails)
  • Exclusive jurisdiction of courts in Sheridan County, Wyoming (for non-arbitrable matters)

You waive any right to participate in class action lawsuits or class-wide arbitration.

12. Modifications to Terms

41Labs LLC reserves the right to modify these Terms and Conditions at any time. When we do:

  • Changes will be effective immediately upon posting to our website
  • We will update the "Last Updated" date at the bottom of this page
  • We may notify you via email for material changes
  • Your continued use of Bot The Builder constitutes acceptance of modified terms

If you do not agree to the modified terms, you must stop using the Services.

13. Miscellaneous

Entire Agreement: These terms constitute the entire agreement between you and 41Labs LLC regarding Bot The Builder.

Severability: If any provision is found unenforceable, the remaining provisions will continue in full force.

No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment: You may not assign these terms without our consent. We may assign our rights to any affiliate or successor.

Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.
